If you live in a neighborhood with a homeowners association, a front entry gate is the kind of exterior change that usually needs approval before it goes up. Here's what Arizona law says about that approval, what decides the timeline, and how to put together an application that's easy to say yes to.
Does a front entry gate need HOA approval?
Usually, yes. HOAs commonly review exterior changes that can be seen from the street, and a gate across your entry is visible by design. Your community's CC&Rs (the declaration) and its design guidelines say exactly what needs review. If you can't find them, ask your HOA or management company for the current copies.
What Arizona law says
Arizona's Planned Communities Act covers design review in HOAs. Section 33-1817 of the Arizona Revised Statutes says approval of architectural designs and plans shall not be unreasonably withheld.
The law doesn't set one statewide deadline for the HOA to answer. The timeline comes from your community's own documents: many declarations and design guidelines give the committee a set number of days to respond, and some say a request is approved if they don't. The clock often starts only when the application is complete, so send everything at once.
This is general information, not legal advice. If a request is denied and you think it shouldn't have been, an Arizona HOA attorney can tell you your options.
What to include in your application
A complete gate application
- Your HOA's application form, filled in and signed
- A drawing or picture of the gate design
- Approximate size: width and height of the opening
- Color and finish
- Photos of your entry today, with where the gate will go marked
- How it mounts: to the walls or columns of the entry
- Any hardware visible from outside, such as a keypad
Many committees want new work to match the home. Pointing out that the gate's color matches your existing trim, light fixtures or garage door can help.
When we quote a gate, we can share the design details you'll need for the application.
After you're approved
Keep the approval letter with your home records. If anything about the design changes before installation, such as the color or a larger keypad, check whether the HOA needs to see the change.
How long does HOA approval take?
It depends on your community's documents. Check your CC&Rs and design guidelines for the review period, and send a complete application so it starts right away.
Can my HOA say no?
Arizona law says approval of architectural designs shall not be unreasonably withheld, but HOAs can still apply their written design standards. Designing to those standards up front helps.
Do I need a city permit too?
Rules vary by city and by project. Ask your city's building or permitting office about your specific gate.
